Overview: Sepeninggal Orde Baru, 21 Mei 1998, Indonesia segera memasuki fase yang disebut dengan "liberalisasi politik awal". Inilah fase yang ditandai oleh serba ketidakpastian dan karenanya dinamai secara teoritis oleh O’Donnell dan Schimitter –dalam bukunya Transisi Menuju Demokrasi: Rangkaian Kemungkinan dan Ketidakpastian-- kurang lebih sebagai fase "transisi dari otoritarianisme entah menuju ke mana".Ternyata, penerapan system Demokrasi liberal (liberalisasi politik) pasca lengsernya Orba, belum juga mampu menuntaskan berbagai problem kebangsaan yang kini melanda bangsa kita. Di samping itu, aspirasi rakyat pun tidak tersalurkan secara utuh. Sebab, prinsip dasar demokrasi liberal –sebagaimana yang diandaikan konsep Negara hokum klasik—adalah individu, masyarakat, ekonomi, dan kebudayaan harus berada di bawah (tunduk pada) kekuasaan negara. Jadi, kebebasan mereka masih terkungkung oleh dominasi Negara.Karena itu, tak heran apabila persoalan-persoalan kebangsaan datang silih berganti. Mulai dari krisis moneter 1997, gesekan antar golongan/agama/suku, kenaikan BBM, bencana alam, pemanasan global, dan lain-lain. Semua persoalan itu mengindikasikan bahwa demokrasi liberal telah gagal (mengalami kebuntuan) untuk memecahkan persoalan bangsa dalam masyarakat yang plural dan majemuk seperti Indonesia ini.Jika demokrasi liberatif sudah tidak mampu lagi memecah persoalan kebangsaan, maka Pertanyaannya adalah; demokrasi seperti apa mampu melakukannya?Jawabannya hanya satu, yakni demokrasi deliberatif sebagaimana yang tersaji dalam buku ini. Buku berjudul Melampaui Negara Hukum Klasik, Locke-Rousseau-Habermas yang ditulis oleh Reza A. A. Wattimena, ini menyajikan konsep demokrasi deliberatif Jurgen Habermas secara komprehensif dan detil. Buku ini menawarkan demokrasi deliberatif yang di gagas Habermas sebagai solusi untuk memecah kebuntuan demokrasi liberal di negeri ini. Yang menjadi titik tolak penulis terhadap pandangan filsafat politik Habermas adalah Buku Jurgen Habermas yang berjudul Between Fact and Norms: Contribution to A Discourse Theory of Law and Democeacy yang menjadi sumber utama buku terbitan Kanisius ini.Demokrasi deliberatif merupakan sebuah bentuk demokrasi yang menempatkan Negara dan masyarakat sebagai subjek, bukan objek sebagaimana konsep demokrasi liberal. Jadi, antara Negara dan warganya tidak ada yang memiliki otoritas paling besar. Keduanya memiliki atau memegang porsi kekuasaan yang sama. Kebijakan politis yang diambil pun harus melalui tindakan komunikatif antar keduanya. Itulah yang diandaikan Habermas dalam teori diskursusnya.Dalam pengantarnya, penulis menjelaskan bahwa buku ini merupakan upaya penulis untuk memberikan sumbang saran teoritis bagi kebuntuan proses demokratisasi di Negara kita. Pada realitasnya, belakangan ini Indonesia mengalami begitu banyak persoalan yang sangat kompleks. Berbagai pesoalan tersebut, secara tidak langsung mengancam keutuhan NKRI. Bangsa Indonesia kini tengah berada di tengah-tengah badai krisis multidimensi yang berakibat pada terciptanya disintegrasi bangsa. (hlm v)Menurut Reza, sudah saatnya bangsa Indonesia menggeser filosofi hukum Negara, dari demokrasi liberalis ke demokrasi deliberatif. Penulis berkeyakinan bahwa Konsep demokrasi deliberatif Jurgen Habermas mampu menciptakan integrasi social dalam ruang kemajemukan. Habermas, yang kita kenal sebagai penerus teori kritis mazhab Frankfurt dan juga penerus tradisi kritis marxisme, berusaha menerapkan tindakan komunikatif dalam proses demokrasi di Negara modern. Dengan metode diskursus yang ditawarkannya, Habermas berhasil melahirkan konsep filosofi hukum Negara yang lebih adil, jujur, dan seimbang; yakni demokrasi deliberatif.Habermas dalam bukunya the Theory of Communicative Action mengandaikan bahwa kebijakan-kebijakan politis harus dilandasi dengan tindakan komunikatif. Demokrasi deliberatif adalah proses demokratisasi politis yang melibatkan semua pihak dalam mengambil kebijakan. Deliberasi yang diandaikan Habermas di sini adalah rasionalitas publik.Dengan model demokrasi deliberatif bagi Negara hukum demokratis modern ini, Habermas telah menyumbangkan suatu model pemerintahan demokratis, yang legitimasinya diraih dari pengunaan rasio secara public oleh seluruh warga Negara. It was okay. It had some good moments, but the overall plot felt a bit disjointed in the second half. Probably won't read it again, but it was an okay way to pass the time.
